Summary

At present, the statements by Parties of National and international levels are regulated in the order ITC/851/2019, of 25 july, which regulates the declaration of festival of national and international levels. This command was an alignment of promotional activities of the parties declared to the reality of the information society. Among other requirements included: that the party had a website, which should take into account the number of search results in browsers and the number of followers in social networks. However, it has been realized the need for some changes, both in relation to the administration of the festival, and to assess requirements for granting of such a way that relate to the new model of sustainable tourism management at an economic dimension, social and environmental.

  1. In relation to the modifications in relation to the administration of the festival is the need to increase the maximum time limit to resolve, the latest three months, taking into account the numerous requirements to value for disclosure of festivity and international levels and the need for the autonomous community has more time to develop its technical report that the applicant of the party must submit with application. The change in Ministerial Order will be an opportunity to include the changes necessary to become more flexible procedure ensuring the rights of asylum in presenting allegations. It will change the current regime of administrative silence positive for negative administrative silence, avoiding the automatic granting without verification of the requirements, for reasons of general interest.
  2. As for what is recognised in the current Ministerial Order for the granting of the declaration of festival of national touristic interest (article 3 of the order), as well as those provided for the holidays of international tourist interest (article 7 of the order), it is advisable to simplification of the treaties at the same time to include other new aspects that promote sustainable tourism and which reflect a positive and attractive of the country. In addition, it will strengthen the weighting of the criteria, according to the technical manual review to be published soon. In this regard should be taken into account the challenges and objectives of the new model of sustainable tourism that are developed through strategic plans and/or marketing plans, either at the national and/or regional level. For that purpose, it will require a plan of sustainability, a plan of coexistence and acoustic management and a contingency plan. It Will Be a good opportunity for the new regulation takes account of the statements of the parties as well as national and international levels as an instrument for promoting seasonal adjustment, deconcentration and product diversification and tourism experiences will attract the maximum profitability and preserving the sustainability of the destinations compatible with the economic development with the coexistence of host communities.
  3. With the amendment of the Ministerial Order will be dealt with the participation of animals at parties who wish to declare national and international levels, in such a way as to guarantee the proper treatment of animals and a positive image of the country while preserving the origin and traditions of the parties in such a way as to guarantee the protection and welfare of animals, specifying the cause of dismissal as ill-treatment of animals or violence/serious risk to people, in accordance with the law 7/2023, of 28 march, for the protection of human and animal welfare.
  4. Finally, we want to tackle a new regulation contained in the Ministerial Order concerning the dissemination of the parties, either of the festival of national touristic interest, such as international tourist interest. The latest developments in social networks and in the use of artificial intelligence make the communications and marketing plans have to adapt to new opportunities that these offer. Taking into account appropriate incorporating into the dissemination of the relevant parties some aspects of a mandatory and others as an option to obtain a better assessment through verifiable quality indicators to be set forth in the technical manual. In addition, it will require compliance with the requirements of universal accessibility.
